Huntington
Beach, CA. Wednesday, March 1, 2006.
Leslie A. Kelly dba Amish.Net The Company announced today
that his Attorney, Steven L. Krongold, Esq., BIENERT & KRONGOLD, San Clemente,
CA has filed complaint 2:06-CV-01141
against Chadwick C. Conte and Contemedia LLC,
Amish
Times, and TEXT REDACTED, all located in the Detroit, Michigan,
area. Kelly alleges in his complaint that Chadwick C. Conte, TEXT
REDACTED, downloaded Kelly's keywords
and metatags as well as the customer database and directory categories
at Amish.Net The Website
in his effort to promote the new website, "Everything Amish" Amish
Times. Kelly further alleges that Conte carried out these
actions in an effort
to gain dominance in "amish furniture" listings at Google.com and
Yahoo.com and the on line Amish furniture business to the detriment of
Kelly's website. This action followed an unsuccessful effort by Conte to
purchase Kelly's website Amish.Net The Website and all URLs
and content associated with it in early 2005.
Kelly has operated
Amish.Net The
Website since March 1, 2000. Kelly, who has co-authored
with Doyle Yoder, Millersburg, Ohio,
two photo books on the subject of
the Amish Lifestyle, provides information about the Amish
lifestyle, a directory of tourism opportunities within America's
Amish Country and a listing of businesses that sell Amish made goods on
Amish.Net The
Website.
Prior to its launch, in
consultation with American Web Services, Inc.,
Sacramento, CA, the keywords and metatags were developed
with the latest in search engine optimization techniques. The database
of tourist services providers and regional and local tourism bureaus and
merchants who sell Amish made products was created over four years at
significant expense by way of USPS mailings and e-mail. Amish.Net The
Website also sells advertising to these businesses who wish to take
advantage of its strong placement in search engine results, i.e.,
Yahoo.com and Google.com, for most search terms associated with the
Amish lifestyle, tourism in America's Amish Country and merchants who
sell Amish made goods. In addition to the use of a highly refined set of
metatags and keywords, and an extensive database of vendors, Kelly also
has purchased thirty-two key URLs to assure that potential users of
Amish.Net The Website
are readily able to locate his website.
Charges alleged by Kelly
include direct, contributory and vicarious copyright infringement (17
USC §100 et seq) and violation of the California’s Unfair Competition
Kelly v Amish Times
"Case
2:06-CV-01141 will be heard by the Honorable Manuel Real,

District Court, Santa Ana, California.
